Legislation Re: refused deferral applications
We have been contacted by a few parents worried that their child's deferral application for an extra year's nursery funding was denied.
You may find the following legislation useful to support your appeal for deferment funding.
Pupils are to be educated in accordance with the wishes of their parents.
Education (Scotland) Act 1980 Section 28
Local authority shall provide preschool care for children in need within their area who are aged five or under; and have not yet commenced attendance at a school.
Children (Scotland) Act 1995, Section 27
Parents have a duty to safeguard and promote the child’s health, development and welfare; and when appropriate to provide, the stage of development of their child.

The best interests of the child must be a top priority in all decisions that affect children.
Article 3 of the UNCRC
A local authority under shall be designed to minimise the effect on any disabled child who is within the authority’s area, of his disability; and to give those children the opportunity to lead lives which are as normal as possible.
